Italy high court overturns Knox acquittal

Amanda Knox and Raffaele Sollecito are awaiting the verdict of their appeal that could see their conviction for the murder of Meredith Kercher overturned.
ROME — Italy's highest criminal court on Tuesday overturned Amanda Knox's acquittal in the slaying of her British roommate and ordered a new trial, prolonging a case that has become a cause celebre in the United States.
Knox called the decision "painful" but said she was confident in the truth.
The Court of Cassation ruled that an appeals court in Florence must re-hear the case against the American student and her Italian ex-boyfriend for the murder of 21-year-old Meredith Kercher. The exact issues that have to be reconsidered won't be known until the court releases its full ruling within 90 days.
Knox, now a student at the University of Washington, stayed up until 2 a.m. Seattle time to hear her fate and issued a statement through a family spokesman.
"It was painful to receive the news that the Italian Supreme Court decided to send my case back for revision when the prosecution's theory of my involvement in Meredith's murder has been repeatedly revealed to be completely unfounded and unfair," the statement said.
Knox said the matter must now be examined by "an objective investigation and a capable prosecution."
"No matter what happens, my family and I will face this continuing legal battle as we always have, confident in the truth and with our heads held high in the face of wrongful accusations and unreasonable adversity," Knox said in the statement.
Kercher's body was found in November 2007 in her bedroom of the house she shared with Knox and others in Perugia, an Italian university town where the two women were exchange students. Her throat had been slashed.
Prosecutors alleged Kercher was the victim of a drug-fueled sex game gone awry. Knox and Sollecito denied wrongdoing and said they weren't even in the apartment that night, although they acknowledged they had smoked marijuana and their memories were clouded.
An Ivory Coast man, Rudy Guede, was convicted of the slaying in a separate proceeding and is serving a 16-year sentence. Knox and Sollecito were also initially convicted of the murder and given long prison sentences, but were then acquitted on appeal and released in 2011.
The high court's ruling Tuesday overturned the appeals court acquittals.
"She thought the nightmare was over," Knox attorney Carlo Dalla Vedova said after the decision was released.
Italian law cannot compel Knox to return from the U.S. for the new trial. The appellate court hearing the case could declare her in contempt of court but that carries no additional penalties.
Della Vedova said Knox wouldn't come to Italy "for the moment" but would follow the case from home. He sa
id he didn't think the new appeals trial would begin before early 2014. Asked if she would come to Italy for the trial, he said: "I don't think so."
It is unclear what would happen if she was convicted in a new appeals trial.

I do understand what her team are saying about the competency of the prosecution though. From what little I know of the trial from TV and so on, there were some outlandish claims being made by them, so I can't blame her.

Yes, the Italian investigators totally f*cked up the evidence collection.
And the pile of sh*t was Guede the black guy's.
Why is he silent? Because he got his sentenced reduced to 16 years, and by admitting any quilt at all could cause him to lose further reductions in his sentence, which was originally 30 years.
The Italians cannot organize a f*cking parade.
America really hates to extradite their own citizens.

The only real issue will be her ability to move freely outside the states.

I have read up on it...from what I can figure all they have on her is circumstantial evidence based on her behaviour following the murder...she sure doesn't look innocent to me...but guilty demands a higher standard of proof.

Again, a disinterested observer here. I've passed comment on what I know of this case and that knowledge is superficial at best. The impression is of a legal system that obviously has double and triple jeopardy (and beyond) for any defendant; there are so many bites of the cherry that there can be no cherry left.
Legal disclosure seems non-existent. The prosecution tacks into the wind, making slow progress by sideways movements and introducing frankly bizarre scenarios as 'evidence' and does so without censure.
Of the two, it's the jeopardy aspect that furrows my brow. In my own country, thanks to a weak and exasperated British government capitulating to the shouty agendas of those most concerned with anything but equality in the eyes of the law, a well-concerted and tenacious campaign can result in another trial where an acquittal was the original verdict.
That's the one aspect of the Knox/Kircher saga that bothers me.

You have to be a bit careful with being too disparaging about another country's legal system, Anna.
It isn't really double jeopardy here, this is just lazy US and UK journalism. There has been one trial and, in effect, 3 appeal hearings here, 3 out of 4 of the courts ruling against the fragrant and foxy one. Double jeopardy would only strictly apply if it had been a proper full retrial with a fresh jury in the equivalent of the British crown court. They do have appeal courts in the US and UK too.
Fair comment, Paully. (I thought you were going to pick me up on criminal/civil re. double jeopardy for the same job - so yep, hands up for a bit of lazy shorthand.)
I'm aware of the appeals court in the UK[image: http://www.ajarnforum.net/vb/images/smilies/grin.gif] But I'm only vaguely aware that shortly before my departure from those shores there was a significant change allowing the CPS to balls it up numerous times before getting a result - and that's really the bee in my bonnet regardless of the country.
I know very little having not followed the original trials.
Were I in her position I would find myself most uncomfortable in my own skin, so to speak.
The only comfort I could take is that if there were an effort for an extradiction on the Italian part, it would take a couple of decades clearing the US court sytem, imo.
My understanding is that the US is probably the country least likely to extradite their own citizens.
Gives her lots of time to maneuver.
She can always play the "medical concerns" argument. Cancer of some sort. But that card is saved till the end, if all else fails.

The Italian system does seem odd to us with all these weird names, 'Court of Cassation', etc but it hasn't been all a one way conspiracy against Foxy and her geeky-looking Italian mate, Rafaelle as she is prone to depict. The original appeal in 2011 did quash the first verdict and free them, after all. Even now the first verdict has been reinstated, Sollecito hasn't been imprisoned but merely restricted to Italy pending the final appeal in Rome.

Personally I think she should be deported and she should face the music in Italy. This wasn't a kangaroo court, but a high level judicial court in a democratic nation. None of us know the case or the evidence, only the information fed to use through the media. So I'm not going to pass judgement, but if a court has found her guilty then she needs to do the time.
With regards to the whole extradition issues, there is no legal basis to refuse to extradite, and that hundreds of people, many from minorities, are in US prisons on less evidence than there was against Knox without any public outcry.

You cannot be deported from your own country. This is about possible extradition.
The evidence of this case is known to all who have followed.

There are grounds based on basic fairness of process. I don't think an extradition hearing could specifically consider guilt, but they would have to consider any argument that Knox would be prejudiced because of a difference in judicial procedure.
From the outside although Knox looks a strange girl to say the least, and the photo of her kissing the boyfriend after the murder is chilling, that does not amount to proof of murder, only suspicion. Any judicial procedure that failed to address that from the outset could be grounds against extradition.

I saw that video of Knox kissing her boyfriend Sollecito - the original and the cropped / edited version.
Whoever showed that video on (Italian TV?) cropped it. Edited it. They were both sad and consoling each other. Then at some time the did a 'peck' kiss a couple times. Then they went back to consoling each other and being sad. The should the edited footage only. Hmm.....?
Remember the Italian courts and media citing the motive as Satanism? They did. Anti-foreigner sentiment as well at that local protests even though all of the accused and victims were foreigners, except for Sollecito.

All the information we have is from the media. It's also going to be fairly likely that most of the US news outlets will be in support of Knox because she's white, female and an American. Knox has been found guilty of a crime in a democratic system. Also, has no one even considered what the Kercher family think? I bet the REAL victim of this sorry affair doesn't even get a mention in US news.
On the extradition side, Alan Dershowitz (Harvard law) describes the American supporters of Knox as one-sided and poorly informed about the evidence against her. According to Dershowitz, in view of the US government's need for international cooperation in its own extradition requests, Knox would be extradited to Italy regardless of American public opinion.

He's right, of course. If Meredith had been American and Amanda Knox British, the US press would be positively baying for an extradition.
The point, as Dershowitz well knows, is that as there is an extradition treaty already in place between the US and Italy, in effect the US has formally recognised that the Italian legal system is a perfectly legitimate and fair one. Public opinion should not come into it, but of course it does.

The judge actually reinstated the verdict. In the next few months they could either uphold the verdict and make the convictions definitive – in which case Italy could request Knox's extradition and Sollecito would be facing a return to jail – or send the case back for another appeal.
We won't know exactly what the Florence court's reasons were until it releases its written "motivazioni". For me I would have her over there ASAP, just so I don't have to see those crocodile tears.
Although Italy and the United States have an extradition agreement, most experts agree Rome would be very unlikely to request her transfer before the court of cassation had confirmed her conviction. If that were to happen – and a decision is not expected before next spring – it is not certain whether Italy would request the extradition or whether the US would agree to it if it did.

Only if the supreme court ratifies the original conviction + sentence, 28 years in her case. Remember that Sollecito isn't yet locked up in Italy, merely confined to the jurisdiction of that country to stop him doing a runner. Luckily he 'remembered' to return from Austria before being found.

It was, of course, the US government with a wealth of high-powered legal advice available to it which ratified the extradition treaty. The allowing of extradition by the US will be because of reciprocity in the future.
In the future, let's say Italy has an American fugitive or terror suspect. Italy could refuse to extradite as a tit-for-tat. It's all about possibilities.
As for the reciprocity, Knox is expendable IMO.
And also, I am not 100% in my view. If someone can post up some corroborated evidence against here I am willing to look at it.
But there have been a few books written about the case - I am reading one now on my Kindle - and they are pointing out the flaws in the evidence collection and actual evidence (DNA on the knife).

I saw that video of Knox kissing her boyfriend Sollecito - the original and the cropped / edited version.
Whoever showed that video on (Italian TV?) cropped it. Edited it. They were both sad and consoling each other. Then at some time the did a 'peck' kiss a couple times. Then they went back to consoling each other and being sad. The should the edited footage only. Hmm.....?
Fair comment...and even though what I saw was edited it looked weird to me...reminded me of that Cracker episode where the crazy couple always bonked after killing somebody...but it doesn't amount to anything near proof...I haven't seen anything that does.
I read that article by the FBI investigator. He correctly describes the lack of proof. There is no way Knox would be convicted in an English or US Court. That must be relevant in any extradition proceedings.

You saw the edited / cropped version. Again, that is another way to basically "frame" someone up, and make them look uncaring, sociopathic, or bad.

Note the accusations and confirmed quotes by the prosecutor. There are many.
